GNC Mega Men Class Action Filed in California
A class action lawsuit (PDF) recently filed in the Northern District of California alleges that GNC engaged in deceptive and misleading labeling with its Mega Men and other dietary supplements. The suit further contends that GNC violated the Federal Food, Drug and Cosmetic Act by selling misbranded supplements without a mandatory disclaimer warning that the products have not been evaluated by the FDA, and that they are “not intended to diagnose, treat, cure, or prevent any disease.” Plaintiffs allege that GNC misled, deceived and ultimately profited off of consumers by selling supplements with labels that lack this warning.
