What’s the Problem?
November 22, 2017 – The new Ikea recall follows news of the death of Jozef Dudek, a 2-year-old California boy who became the 8th child to die under a fallen Malm dresser, according to the Washington Post.
The first Ikea Malm recall was announced in June 2016 and originally reported to affect nearly 30 million dressers, but was later adjusted to include just over 17 million pieces of the furniture. In December 2016, the company reached a $50 million settlement with 3 of the families of children killed by Ikea dressers.
Jozef Dudek was killed when an unsecured 3 drawer Malm dresser fell on him in the bedroom of his Buena Park, California home in May when his parents put him down for a nap. Dudek was in his bedroom alone when the accident occurred, and later found trapped under the dresser by his father.
He is the 8th child who has died from an incident involving an Ikea dresser and the 4th killed specifically by the Malm product, according to CNN.
Can I File a Class Action?
Our lawyers have decided against the filing of a class action lawsuit in the Ikea Malm litigation, and are only filing individual claims on behalf of those alleging serious injury and/or death from furniture tip-over accidents. We feel this is in the best interest of our clients, as class action lawsuits in these types of cases typically result in far lower payouts in exchange for an expedited legal process.
At Schmidt & Clark, LLP, our goal is to maximize compensation for injured parties, and for this reason we will only be filing individual suits. Contact our lawyers today to learn more about your rights if you’ve been injured.
