What’s the problem?

May 1, 2017 – Atrium C-QUR mesh is manufactured from polypropylene, a type of plastic woven together like fabric. It also has an outer coating made of Omega-3 fatty acids, more commonly known as fish oil. Unfortunately, the use of fish oil has caused some patients to experience severe allergic reactions resulting in adverse health complications, according to lawsuits in the multidistrict litigation (MDL No. 2753).
In 2011, the U.S. Food & Drug Administration (FDA) sent a warning letter to Atrium Medical after the agency learned the company had improperly handled complaints that C-Qur mesh was causing dangerous infections. Additionally, there were at least 35 complaints that human hair had been found in hernia patches that were supposed to be sterilized.
Plaintiffs in the MDL allege that Atrium C-Qur mesh has a fish oil coating that produces an allergic reaction which can lead to severe health complications. Additionally, if the hernia patch adheres to the bowel, it could lead to the bowel becoming twisted or perforated, causing gastric ulcers or other adverse intestinal problems, according to the lawsuits.
Plaintiffs further allege that Atrium knew or should have known about the potential risk of hernia patch complications, but that it withheld this information in order to maximize profits. The manufacturer has also been accused of issuing multiple “stealth recalls” for C-Qur mesh products that had high complication rates instead of recalling the devices or even notifying doctors or patients.
