What’s the Problem?
April 24, 2017 – The lawsuit was filed by Joseph Boudreaux, who claims that use of Xarelto caused him internal bleeding which required a week-long stay in an intensive care unit (ICU), numerous blood transfusions and heart procedures.
“I don’t want anybody else to suffer like I have from that drug,” Boudreaux said.
Johnson & Johnson and Bayer AG, which jointly developed Xarelto, are currently facing about 18,000 lawsuits blaming the medicine for serious internal bleeding side effects. Xarelto has also been linked to nearly 400 deaths, according to the U.S. Food & Drug Administration (FDA).
Boudreaux’s case is the first of 4 Xarelto bellwether trials to be overseen by U.S. District Judge Eldon Fallon over the next 3 months. The next lawsuit scheduled for trial is that of Joseph Orr, the husband of a woman who allegedly started taking Xarelto one month before dying of a brain bleed.
Plaintiff in the 3rd trial is Dora Mingo, who claims to have suffered gastrointestinal (GI) bleeding after taking Xarelto to treat blood clots. That case will be tried in Mississippi. The 4th case involves William Henry, a man who allegedly died from a GI bleed after taking Xarelto as an atrial fibrillation treatment. His case will be tried in Texas.
The thousands of other federal Xarelto lawsuits have been consolidated in a multidistrict litigation (MDL No. 2592) in the Eastern District of Louisiana. The outcomes of the bellwether trials may help determine the value of certain injuries during settlement negotiations.
