What’s the Problem?
The class action, James Martin v. GNC Holdings, Inc. Case No. 2:15-cv-01522-NBF, alleges that Turbo Shred contains BMPEA and picamilon, “substances that do not meet the statutory definition of a dietary ingredient,” according to the U.S. Food & Drug Administration (FDA). Plaintiff alleges that GNC knew or should have known about these potentially unsafe and illegal ingredients and misrepresented Turbo Shred and other similar products as lawful dietary supplements.

What is Picamilon?
“Picamilon is a unique chemical entity synthesized from the dietary ingredients niacin and gamma-aminobutyric acid,” according to the FDA. “Picamilon is absorbed into the body, crosses the blood-brain barrier and accumulates in the brain as a separate chemical entity. Because picamilon does not fit any of the categories of dietary ingredients under the Act, any products marketed as dietary supplements that declare picamilon as a dietary ingredient are misbranded.”
