What’s the Problem?
Plaintiffs Michael and Debra Weddle filed the class action in BC Supreme Court on June 30. According to the complaint, Michael Weddle was prescribed Pradaxa in 2010 for a cardiac arrhythmia, and in November 2012 was hospitalized for a week in intensive care after experiencing pericardial bleeding.
Weddle had no prior bleeding condition before taking Pradaxa and was allegedly never warned about the medication’s potential to cause “uncontrollable bleeding and lack of reversal agent.” Had he understood the “magnitude of risk” associated with Pradaxa use, Weddle would have never taken the drug, according to the lawsuit.
Meanwhile, the complaint asserts that Boehringer knew or should have known of these dangers, and “failed to draw attention to the lack of effective reversal agent.”
In May 2014, the company settled about 4,000 Pradaxa lawsuits in the U.S. for $650 million. Boehringer did not admit liability and claims it settled to avoid protracted litigation.
The Weddles seek class action certification, $100,000 in damages for each family law claimant under the Family Compensation Act and $5 million in punitive, aggravated and exemplary damages. The defendants include:
- Boehringer Ingelheim Pharmaceuticals Inc;
- Boehringer Ingelheim International GMBH, and
- Boehringer Ingelheim (Canada) Ltd.
