What’s the Problem?

January 23, 2017 – The complaint was filed by Willie Calloway, who was implanted with C-Qur mesh in 2010 while undergoing surgery to repair a hernia in her belly button. Calloway claims she required another hernia repair surgery 5 years later after developing a painful lump where the mesh patch had been placed.
Doctors found that large adhesions had developed between the C-Qur mesh and her small bowel, requiring surgeons to remove two feet of her bowel because the damage was so extensive, according to the lawsuit.
Plaintiff claims Atrium Medical’s negligence caused her to develop severe injuries including chronic inflammation, adhesions, and an embedded mesh. She sued Atrium and its parent companies Maquet and Getinge Group, alleging counts of defective manufacture and design, failure to warn, and negligence.
Atrium C-Qur hernia mesh entered the U.S. market in March 2006 via the Food & Drug Administration’s 510(k) approval program, which allows companies to skip rigorous pre-market research and studies. C-Qur mesh was approved because it was “substantially equivalent” to another product that was approved in the 1990s. However, the C-Qur patch is the first mesh to ever utilize an omega 3 fatty acid coating. Devices approved through 510(k) are susceptible to lawsuits, unlike products that undergo extensive testing for Pre-Market Approval (PMA).
Calloway’s lawsuit is one of over 20 complaints pending in the newly formed Atrium C-Qur Hernia Mesh Multidistrict Litigation (MDL No. 2753) in the U.S. District Court for the District of New Hampshire. Her case (2:17-cv-00060) was recently transferred from federal court in Western Pennsylvania to New Hampshire.
