A woman who claims her doctor was unable to retrieve an Option ELITE IVC filter from her body has filed a products liability lawsuit in the Philadelphia County Court of Common Pleas.

What’s the Problem?
March 3, 2017 – Plaintiff Debra Victor of Apple Valley, CA., is claiming that the Argon Option ELITE IVC filter is defective, after her doctor was unable to retrieve the device from her body due to it becoming embedded in her vena cava.
The lawsuit, which was filed on Feb. 17 in the Philadelphia County Court of Common Pleas, alleges that Argon and Rex Medical failed to warn consumers of the health risks of the Option ELITE filter, and marketed a device that could result in complications including:
- Hemorrhage
- Cardiac/pericardial tamponade
- Cardiac arrhythmia and other symptoms if myocardial infarction
- Perforations of tissue, vessels and organs
- Other severe personal injuries and diseases
In May 2014, the U.S. Food & Drug Administration (FDA) recommended retrieving temporary IVC filters within 29-54 days of implantation. According to the lawsuit, Victor’s Argon IVC filter was left implanted for more than a year and a half before her doctor attempted retrieving it.
Plaintiff alleges counts of negligence, strict products liability, failure to warn, and breach of warranty. Victor is seeking a jury trial and recovery for all claims of action related to the lawsuit, all appropriate fees and expenses, plus punitive damages and any other relief the court deems fit.
The case is: Philadelphia County Court of Common Pleas case 170204272.
