What’s the Problem?

Our lawyers are filing lawsuits against fertility clinics in San Francisco, Cleveland, and elsewhere alleging that their negligence in mishandling frozen eggs and embryos compromised their viability. Information has recently surfaced indicating that the temperature of the tissues in the storage banks, in which the embryos are stored in liquid nitrogen, may have fluctuated unexpectedly. This difficult situation has been made even harder on families by the fact that the eggs and embryos must be completely thawed in order to determine whether they remain viable.

Victims of Pacific Fertility Clinic File Suit

A woman whose frozen eggs were stored at the Pacific Fertility Center has filed a federal class action lawsuit in San Francisco, accusing the company of negligence in its maintenance, inspection and monitoring of a storage freezer that malfunctioned earlier this month. Officials at the facility have acknowledged that some — or potentially all — of the tissues may have been damaged beyond repair, according to The Washington Post. The clinic’s actions represent an “extreme departure from what a reasonably careful person would do in the same situation to prevent foreseeable loss of human reproductive tissue,” according to the suit.

Can I File a Class Action?

Our lawyers have decided against the filing of a class action lawsuit in the fertility clinic litigation, and are only filing individual suits on behalf of women whose embryos or eggs were harmed while in the care of a fertility clinic. We decided on this course of action because it has been our experience that class actions often result in lower payouts and higher attorney fees to many class members. We plan on maximizing compensation to our clients, and believe that individual suits are more likely to result in such a conclusion.
