What’s the Problem?

October 26, 2017 – According to the lawsuit, Plaintiff “Rocky” underwent total knee replacement surgery in January 2015 with the DePuy Synthes implant, after which he developed “severe pain, swelling, and instability in the knee and leg caused by loosening.” The device was subsequently found to be defective, and Rocky was forced to have knee revision surgery to remove the implant in July 2017, the complaint states.
Rocky isn’t the only one who’s complaining about problems with the DePuy Synthes knee. Many others who have received the knee replacement have suffered from “fractures, infection, soft tissue injury and permanent damage to bones and nerves following revision surgery,” according to the lawsuit.
The DePuy Synthes Attune Knee System was manufactured with a reduced femoral radius, a so-called “S-curve” design, an adjustable tibial base, and new polyethylene formation, the complaint states.
Additionally, the knee replacement was granted approval in December 2010 through the FDA’s controversial 510(k) process, which fastracks devices that are “substantially equivalent” to existing products.
This is not the first time DePuy knee implants have been linked to adverse health consequences. Back in 2013, the company recalled its LPS Diaphyseal Sleeve and the LPS Lower Extremity Dovetail Intercalary Component over concerns that the devices could fail during routine physical activities. FDA issued its most serious Class I Recall, which indicates a reasonable probability that use of the products “will cause serious adverse health consequences or death.”
