What’s the Problem?
The suit alleges that developer Hilco, MCM Management Corp, and Controlled Demolition violated the Illinois Environmental Protection Act, Illinois Pollution Control Board regulations, and their permit governing the discharge of pollutants into stormwater following the implosion of the nearly 400-foot smokestack on April 11, 2020.
The demolition caused dust to cover the Little Village neighborhood, forcing residents to inhale noxious gasses, dust, and other pollutants for days. Chicago officials issued a stop-work order at the site following the implosion and fined Hilco $68,000.
“The companies responsible for the demolition of the Crawford Power Generating Station’s smokestack failed to take steps to protect the community from air pollution and compromised air quality at a time when we are urging residents to remain in their communities to minimize the spread of a deadly respiratory disease,” Raoul said in the complaint. “I am committed to holding the defendants accountable for the environmental damage done to the Little Village community and working to address any remaining contamination.”
Raoul is seeking undetermined civil penalties and demanding that Hilco take corrective actions to protect Little Village residents from air pollution.
In addition to the suit filed by Raoul, at least 2 other complaints have been filed against Hilco by Little Village residents alleging health effects from the implosion, in addition to a wrongful death suit filed by the family of a worker who fell to his death.
