What’s the problem?
October 6, 2016 – There are currently at least 22 Abilify lawsuits pending in 12 different jurisdictions, according to the Transfer Order (PDF), in addition to another 20 complaints in 14 districts that the judges were recently notified about.
While Abilify labels previously warned about serious side effects such as suicidal thoughts and an increased risk of death in elderly patients with dementia, there was no warning about compulsive behavior, binge eating or sex addiction until recently. In May 2016, the U.S. Food & Drug Administration (FDA) announced that it was requiring updated warnings on Abilify labels regarding an increased risk for uncontrollable urges to gamble, eat, shop and have sex. FDA said it had received at least 184 reports of impulse-control disorders since Abilify was first approved in November 2002.
All of the complaints in the MDL allege that drugmakers Bristol-Myers Squibb and Otsuka Pharmaceutical failed to adequately warn about Abilify’s potential to cause compulsive behavior problems. Centralization of the cases allows all pending federal cases, as well as those filed in the future, to undergo coordinated pretrial proceedings, including discovery and motions practice. This process promotes judicial efficiency, streamlines the litigation process, and serves the best interest of all parties involved.
