What’s the Problem?
September 1, 2016 – FDA said it has received reports of problems with intraoperative or postoperative bleeding and hematomas, some of which required clinical interventions, and at least 3 patient deaths which occurred shortly after the Vascu-Guard Patch was used in carotid endarterectomy (CEA) procedures.
“The FDA concerned that the Vascu-Guard patch may not be performing as intended and that patients who are treated with the product may be at risk for serious adverse health consequences, such as severe bleeding, hematomas, and death,” FDA said in the safety alert.
The agency said that when the Vascu-Guard patch is used during CEA surgery, arterial bleeding in the neck could cause airway obstruction, hypoxia, diminished brain perfusion, stroke or cardiac arrest.
FDA recommends that healthcare providers who work with the Baxter Peripheral Vascular Patch discuss treatment options with patients and “employ heightened post-operative vigilance” to watch for signs of early bleeding.
Is There a Class Action?
Our law firm has decided against the filing of a Vascu-Guard Patch Class Action Suit. However, we are currently accepting potential individual lawsuits on behalf of individuals who were injured after receiving the patch.
The problem with class action lawsuits in cases like these is that many class members are often forced into a blanket “low ball settlement” and higher attorney fees. Our lawyers understand that injured parties are suffering emotionally and economically due to loss of wages and/or high medical bills, and we plan to maximize each client’s recovery by filing individual peripheral vascular patch lawsuits on their behalf.
