What’s the Problem?
June 19, 2017 – U.S. District Judge Matthew Kennelly of the Northern District of Illinois granted an oral motion by the plaintiffs for a mistrial and ordered a new trial to begin September 18, according to Law360.
The attorney was serving as lead counsel for Plaintiff Jeffrey Konrad, who claims he suffered a heart attack in 2010 after taking AndroGel. The case was the first of approximately 6,000 similar complaints filed over AndroGel and other testosterone replacement therapy (TRT) products to go to trial.
The suits, which have been centralized in a multidistrict (MDL No. 2545) in the Northern District of Illinois, allege that testosterone boosters cause heart attacks, strokes and blood clots.
The case was the first of 6 testosterone bellwether trials scheduled for this year. Konrad, 56, alleged that he suffered a heart attack after taking AndroGel for about 2 months.
His suit claims that AbbVie made false statements in advertising and marketing materials about how many men actually suffered from low testosterone (“Low T”) — rather than just the symptoms of old age – in an attempt to boost sales of AndroGel.
A second bellwether trial is set to kick off next month. That trial, and a third trial, similarly allege that AndroGel caused heart attacks or strokes, while the latter three trials claim AndroGel caused blood clots.
