A California family has filed the first lawsuit over an E. coli outbreak linked to I.M. Healthy SoyNut Butter.

What’s the Problem?
March 8, 2017 – According to the lawsuit, 8-year-old Trevor Simmons is one of 12 people across the U.S. sickened by a potentially deadly strain of E. coli linked to contaminated soy nut butter manufactured by the SoyNut Butter Company of Illinois and sold under the brand name I.M. Healthy.
Trevor is back home and recovering from the E. coli infection, but is facing “uncertain future medical complications,” according to the lawsuit.
“It was like the worst thing in my life,” Trevor said. “I don’t want to have it ever again.”
Trevor’s parents Mosby and Erin Simmons say the boy became sick within days of eating I.M. Healthy SoyNut Butter in late January, after which he was admitted to a hospital, first with diarrhea and then worsening complications.
“I had nurses tell me at Good Samaritan (hospital), ‘He’s too sick to be here. He’s got something else,” Erin said. “This wasn’t an E. coli that you would get and recover from in 3 days.”
Trevor was transferred to Stanford Children’s Hospital, where he was diagnosed with one of the most violent and potentially deadly forms of E. coli — 0157:H7 — a Shiga toxin-producing strain.
With the help of the Centers for Disease Control and Prevention (CDC), Stanford doctors were able to trace the source of Trevor’s illness to the soy nut butter.
“It was still in our pantry,” Erin said. “We could have all had it. He could have eaten more of it.”
I.M. Healthy SoyNut Butter Recall Expanded
On March 4, the SoyNut Butter Company expanded the initial recall to include the following products:
- 15-ounce plastic jars of I.M. Healthy Original Creamy SoyNut Butter with the Best By dates July 05, 2018, August 30, 2018, and August 31, 2018;
- Individual portion cups of I.M. Healthy Original Creamy SoyNut Butter with the Best By date as August 08, 2018; and
- 4-pound plastic tubs of I.M. Healthy Original Creamy SoyNut Butter with Best By dates of November 16, 2018, and July 25, 2018.
CDC is warning consumers not to eat any I.M. Healthy brand products with soy nut butter, including granola.
