Janssen Pharmaceuticals has settled the lawsuit of a New York boy who developed abnormal breast growth or “gynecomastia” after taking Risperdal (generic: risperidone) just before the trial was scheduled to begin in Philadelphia.

What’s the Problem?
January 11, 2017 – The Risperdal lawsuit, Zachary Sabol et al. v. Janssen Pharmaceuticals Inc. et al., case number 130402100, was settled out of court for an undisclosed amount. It would have been the 7th trial in Philadelphia’s mass tort program, where at least 2,300 cases are pending against Janssen.
Sabol and his family filed the lawsuit against Janssen in 2013 in the Philadelphia Court of Common Pleas, alleging that he developed gynecomastia after taking Risperdal for about 10 years.
The U.S. Food & Drug Administration (FDA) approved Risperdal in 2006 for the treatment of autism in adolescents. When Sabol was initially prescribed the medication, however, it was only approved for use in adults and the labeling said that gynecomastia was a rare side effect that occurred in less 1 in 1,000 patients. Warning labels were later updated to indicate that there was a 2.3% rate of gynecomastia in adolescents who took the drug.
The Risperdal litigation has continued for over 3 years in the Philadelphia Court of Common Pleas. Another 16,000 cases have been consolidated in California Superior Court in Los Angeles, with the first trials set to begin this July.
Three prior Risperdal lawsuits have resulted in verdicts for plaintiffs in the amounts of $2.5 Million, $1.75 Million, and $500,000. In all the trials, juries have found that Janssen failed to adequately warn about the risk of gynecomastia with Risperdal.
