What’s the Problem?

March 28, 2017 – The case would have been the 7th Risperdal gynecomastia lawsuit to go to trial, and marks the 3rd such complaint which has ended in favor of J&J and its Janssen division, which manufactures the drug.

According to Law360, Janssen last month petitioned Judge Arnold for summary judgement, which he granted.

The plaintiffs plan to appeal the ruling, claiming that the prescribing doctor never would have considered Risperdal if he had been given an accurate warning as to the drug’s potential to cause gynecomastia.

According to the lawsuit, the plaintiff, identified only as “P.D.” in court documents, was 8-years-old when he was prescribed Risperdal to treat the symptoms of attention deficit hyperactivity disorder (ADHD).

P.D. subsequently began to suffer from abnormal breast growth and his parents sued, alleging that Janssen and J&J failed to warn of the potential side effect. However, defendants countered with the claim that one of the boy’s physicians testified that she would have continued to prescribe Risperdal, regardless of whether there was a new warning because “the benefit of treatment outweighs any risk of the side effect.”

The single-page ruling by Judge New granted summary judgement to the defendants based on “the specific facts of this matter.”

The case is P.D. et al. v. Janssen Pharmaceuticals Inc., Case No. 130600738, in the Court of Common Pleas of Philadelphia County, Pennsylvania.
