A man from Hanover, Pennsylvania, who claims he developed a severe M. Chimaera infection after undergoing open-heart surgery which involved use of the company’s Stӧckert 3T heater-cooler unit has filed a products liability lawsuit against the manufacturer.

What’s the Problem?
October 4, 2017 – According to the lawsuit, Plaintiff Richard Whipkey underwent an aortic valve replacement in May 2015, and shortly thereafter began experiencing strange health problems. Whipkey scheduled an appointment with his physician and was subsequently diagnosed with an M. Chimaera infection, which was directly caused by his exposure to the heater-cooler machine during heart surgery, the complaint states.
Heater-cooler systems are used during cardiothoracic surgery and other medical procedures to warm or cool a patient in order to optimize care and improve outcomes. The devices feature water tanks that transport temperature-controlled water to external heat exchangers or warming/cooling blankets through closed circuits.
Although the water transported through the heater-cooler does not come into direct contact with the patient, there is a potential for contaminated water to enter other parts of the device or transmit bacteria through the air via its exhaust vent and onto the patient, resulting in a life-threatening infection.
Whipkey filed the suit on July 13, 2017, in the U.S. District Court for the Middle District of Pennsylvania. The complaint names Livanova Deutschland GMBH and Sorin Group USA Inc., as defendants, bringing claims of negligence, design defects and other damages.
