A third lawsuit has been filed against the SoyNut Butter Company of Illinois by a husband and wife from California who are alleging E. coli poisoning from I.M. Healthy SoyNut Butter.

What’s the problem?
March 17, 2017 – Plaintiffs in the latest lawsuit (PDF), Kelli and Derek Vanderby of Sonoma County, California, purchased I.M. Healthy SoyNut Butter, with Kelli eating it regularly in the days leading up to her illness.
On or about Jan. 20, Kelli started developing severe gastrointestinal symptoms, and 3 days later was admitted to Petaluma Hospital, when she was diagnosed with an E. coli 0157:H7 infection. She was hospitalized for 5 days and continues to recover, according to the lawsuit.
At least 12 people in 9 states had been infected with the E. coli outbreak strain STEC O157:H7, according to the Centers for Disease Control and Prevention (CDC). The agency is warning child care centers in particular to check for any unused SoyNut Butter and discard it securely so that no children or animals can get to it.
“CDC recommends that consumers do not eat, and childcare centers, schools, and other institutions do not serve, any I.M. Healthy brand SoyNut Butter varieties and sizes, or I.M. Healthy brand granola coated with SoyNut Butter,” CDC said. “Even if some of the SoyNut Butter or granola was eaten or served and no one got sick, throw the rest of the product away.”
The new suit follows 2 similar complaints filed last week, both of which allege E. coli infection from I.M. Healthy SoyNut Butter. All of the lawsuits name “John Doe Manufacturer” as a defendant in an effort to force the actual manufacturer of the contaminated soy nut butter.
The Vanderby lawsuit was filed on March 16, 2017, in the Northern District of Illinois, Eastern Division, under case number 1:17-cv-02055.
