What’s the problem?
November 14, 2016 – Plaintiff Diane Shannon filed the complaint (case number 16L010954) last Monday in Cook County Circuit Court, alleging that the defendants failed to safeguard her care. According to the lawsuit, she suffered burns to multiple parts of her body after having surgery with the Bair Hugger machine.
Bair Hugger forced-air warming blankets are designed to increase patient comfort, reduce bleeding and reduce the risk of infections and post-operative heart attacks. However, reports have surfaced of patients being burned from exposure to heat during the surgery or equipment malfunctions that allowed cold air to circulate underneath the blanket. Bair Hugger machines have also been linked to hundreds of reports of MRSA, sepsis and deep joint infections.
Shannon is suing for damages in excess of $50,000 plus court costs. If the case proceeds, it may be transferred to the U.S. District Court for the District of Minnesota, where around 700 similar complaints have been consolidated in a multidistrict litigation (MDL) for pretrial handling.
The complaints allege that the Bair Hugger machine disrupts air ventilation in the operation room, causing infections and burns which have led to multiple surgeries and even amputation of affected limbs. The suits further claim that 3M has been aware of the infection problem since at least 2009.
