The Pittsburgh-based parent company of vitamin retailer GNC has agreed to pay $2.25 million to settle Justice Department claims that a version of the pre-workout supplement OxyElite Pro that found its way to store shelves in 2013 was misbranded.

What’s the problem?
December 8, 2016 – The government says the supplement in question, GNC’s OxyElite Pro Advanced Formula, contained Chinese-made synthetic stimulants rather than natural plant extracts listed on the label, according to Reuters.
A Justice Department investigation found that GNC relied on information from USPlabs LLC, a Dallas company that was indicted last November for allegedly conspiring to import ingredients from China using false labeling and documentation. The company has denied wrongdoing.
Benjamin Mizer, head of the Justice Department’s civil division, says companies like GNC must take stricter measures to avoid selling “products containing questionable and untested ingredients.”
As part of the settlement, GNC has committed to improving their practices and promised not to sell products the U.S. Food & Drug Administration (FDA) has issued warnings about. The company has also been ordered to establish a list of “acceptable and non-acceptable” dietary supplement ingredients.
The agreement represents a guarantee of GNC’s “full compliance” with the Federal Food, Drug and Cosmetic Act. As part of the agreement, the company has also vowed to come up with a quality seal program that will become a standard in the industry.
GNC representatives said that USP Labs’ products are no longer carried by the company, and that USP provided them with “false assurances” related to the safety of its products. They are pleased the issue of misbranded supplements has been resolved.
