What’s the Problem?
The plaintiffs allege that at least 2 people have tested positive for norovirus, and that Chipotle confirmed the symptoms of the other victims were consistent with the virus. They say Chipotle is responsible for the illnesses because it failed to take appropriate cleaning measures.
Over the past 3 years, Chipotle has been tormented by at least a half dozen food poisoning outbreaks involving norovirus, salmonella and E.coli. Despite a host of new measures taken to avoid these mishaps, the illnesses just keep coming.
Hogan and Moore are seeking damages for pain and suffering, mental anguish, physical impairment, physical disfigurement, loss of enjoyment of life, medical and pharmaceutical expenses, travel and travel-related expenses, emotional distress, lost wages, lost earning capacity, punitive and/or exemplary damages and attorneys’ fees in excess of $74,000 plus interest.
