What’s the Problem?
November 8, 2017 – The complaint (Cook County Circuit Court case number 2017L009793) was filed on Sept. 27 by Ann Marie Van Damme, who alleges that Biological Resource Center of Illinois LLC allowed the remains of David Scott Van Damme to be sold for profit.
Plaintiff similarly claims that the defendant made false representations and promises to her regarding how they intended to use the remains of the deceased.
In 2015, a class action was filed against Phoenix-based Biological Resource Center, Inc., accusing it and other defendants of representing that bodily remains donated to them would be used for medical education and research, but in actuality were actually dismembered, sold for profit, mishandled and improperly disposed of on the black market.
Stephen Gore, owner of the facility, pleaded guilty to a class 3 felony in connection with the defendants’ fraudulent and illegal activity. He was sentenced to 4 years probation and a deferred sentence of 12 months in jail for the crimes, according to the Maricopa County Superior Court.
Plaintiff in the Van Damme case is seeking judgment against the defendant for actual, compensatory, punitive damages, court costs and any further relief this court grants. The case was filed in Cook County Circuit Court on Sept. 27, 2017.
