Benicar Lawsuit Allegations

May 11, 2015 – The new lawsuits allege that Daiichi Sankyo and Forest Laboratories designed Benicar in a defective manner and failed to warn that the drug could cause:

  • Chronic diarrhea
  • Nausea
  • Malnutrition
  • Dehydration
  • Weight loss
  • Sprue-like enteropathy

Benicar Enteropathy FDA Warning

On July 3, 2015, the U.S. Food & Drug Administration (FDA) issued a warning which stated that Benicar had been linked to sprue-like enteropathy, and that the medication’s warning label would be updated to reflect this risk. At the time of the warning, FDA had received at least 23 reports of late-onset diarrhea among patients treated with Benicar.

Benicar was first linked to enteropathy in June 2012, when a research team at the Mayo Clinic identified 22 Benicar users with symptoms similar to those produced by celiac disease, but whose test results failed to support the diagnosis. In all cases, the patients’ symptoms improved after they discontinued treatment with Benicar.

How Does Benicar Work?

Benicar is an angiotensin II receptor blocker (ARB) approved to treat high blood pressure (hypertension) in adults and children over the age of 6. The drug works by relaxing blood vessels so that blood can flow more easily and the heart can pump more efficiently. Lowering high blood pressure can help reduce the risk of stroke, heart attack and kidney problems.

Status of Benicar Litigation

It is expected that the number of lawsuits filed over Benicar will continue to grow throughout 2015. The first complaints were filed in the early part of last year. Amid the mounting litigation, the federal cases were centralized as part of a multidistrict litigation (MDL) in April 2015, and a number of state court cases pending in New Jersey have been centralized as part of a multicounty litigation, or MCL.

Can I File a Benicar Lawsuit?

Only a qualified attorney can determine whether you are eligible to file a lawsuit against the maker of Benicar, which is why we are currently offering free case evaluations. Simply fill out the confidential evaluation form below to contact our law firm now.

Most cases involving pharmaceuticals allege that a drug was sold with design, manufacturing, and/or marketing defects, which typically refers to a company’s failure to warn of a certain side effect. In the case of Benicar, our attorneys suspect that patients may be able to take legal action in light of claims that the manufacturers failed to adequately warn doctors and patients about the risk of sprue-like enteropathy.

How Can Filing a Lawsuit Help Me?

By filing a lawsuit against the maker of Benicar, you may be entitled to collect compensation for all current and future medical expenses related to the treatment of your injury, as well as for damages for pain and suffering. Additionally, filing a lawsuit can help hold the drug’s manufacturer accountable for releasing an allegedly defective drug into the marketplace, and to discourage other pharmaceutical companies from engaging in similar conduct.
