January 3, 2019 – A federal jury in the Northern District of Illinois has found AbbVie Inc. guilty of failing to adequately warn of the severe side effects associated with AndroGel, ordering the company to fork over $3 million to Plaintiff Jesse Mitchell, who claims the testosterone booster contributed to his development of a life-threatening heart attack.

The verdict marked the end of another AndroGel bellwether trial, as well as Mitchell’s second trial over the testosterone booster. The plaintiff’s case initially went to trial last summer, when he was awarded $150 million in punitive damages. However, that verdict was overturned over by U.S. District Judge Matthew Kennelly, who found the award “logically incompatible.”
Mitchell’s second trial took more than 2 weeks, and his award included $200,000 in compensatory damages and $3 million in punitive damages.
The case marked the 4th bellwether trial for AbbVie in the Testosterone MDL currently underway in the Northern District of Illinois. Thousands of complaints are still pending in the litigation, each involving similar allegations of severe cardiovascular damage stemming from the use of testosterone supplements.
The case is: Mitchell et al. v. AbbVie Inc. et al., case number 1:14-cv-09178.
