What’s the Problem?
July 27, 2017 – The jury ruled that AbbVie misled Plaintiff Jesse Mitchell and his doctor regarding AndroGel’s potential to cause blood clots, which can lead to a heart attack, according to Bloomberg. Mitchell, a 54-year-old laundry manager, had a heart attack in 2012 after using AndroGel for about 4 years.
In an unusual outcome, the Chicago panel awarded Mitchell nothing in compensatory damages from the heart attack, but stuck it to AbbVie with $150 million in punitive damages, after ruling that the company had made fraudulent misrepresentations about the safety of AndroGel.
Mitchell’s lawsuit is the first of thousands of similar lawsuits filed over the alleged side effects of AndroGel to go to trial. The complaints have been consolidated in a multidistrict litigation (MDL No. 2545) in the Northern District of Illinois before U.S. District Judge Matthew Kennelly.
Plaintiffs accuse AbbVie and other testosterone manufacturers of hiding or downplaying the risks of their products, as well as violating federal law with aggressive marketing campaigns. AndroGel has been linked to at least 4 fatal heart attacks, according to Bloomberg.
The U.S. Food and Drug Administration (FDA) approved AndroGel in 2011 for the treatment of hypogonadism, a severe loss of testosterone, but not for testosterone loss associated with the normal aging process. Regulators moved to strengthen safety warnings after a study published in the Journal of the American Medical Association (JAMA) found that testosterone increased the risk of heart attack and stroke by nearly 30%.
