Also this week, the first lawsuit alleging damages in the E. coli outbreak was filed on behalf of Melissa Carmicle of Laurel County, Kentucky, who claims she had seizures and developed kidney failure after eating tainted beef produced by K2D Foods, which issued a recall for 113,000 pounds of meat on Tuesday.

What’s the Problem?
Carmicle alleges she was hospitalized for 3 days to treat her failing kidneys, and then began having seizures after she was discharged from the hospital. Plaintiff is seeking damages in excess of $75,000, saying the defendants are liable for selling “unreasonably dangerous and defective ground beef.” The complaint was filed in U.S. District Court for the Eastern District of Kentucky.
E. Coli Symptoms
Escherichia coli (E. coli) bacteria normally live in the intestines of healthy people and animals, according to the Mayo Clinic. Most types of the bacterium are relatively harmless and cause brief diarrhea and other gastrointestinal symptoms. However, a few vicious strains, such as E. coli O157:H7, can cause severe abdominal cramps, bloody diarrhea and vomiting.
Outbreak E. Coli Strain “Hard to Identify,” Officials Say
The strain of E. coli linked to the two major ground beef recalls this week has been harder to identify than usual, according to the USDA Food Safety Inspection Service (FSIS). Food safety officials are investigating the outbreak strain, with many of those who fell ill reporting having eaten at a restaurant prior to their onset of symptoms. Beef collected from those restaurants was contaminated with the same strain of E. coli, but authorities haven’t definitively linked the two.
